These Terms of Use ("Terms") govern your use of the BuiltDaily iOS application (the "App"), provided by Venture Ink, LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple devices that you own or control, solely for your personal, non-commercial use, subject to these Terms and the Apple App Store Terms of Service.

2. Health and fitness disclaimer

The App is for general fitness and wellness tracking only. It is not a medical device and does not provide medical advice, diagnosis, or treatment.

The App displays data from Apple HealthKit and from your own logging. It does not interpret that data clinically.
Always consult a qualified healthcare professional before starting, changing, or stopping any exercise, hydration, or training program.
Do not rely on the App for emergency medical situations. If you think you may have a medical emergency, call your local emergency number immediately.
You are solely responsible for your own health and safety, including any decisions or actions you take based on data shown in the App.

3. Acceptable use

You agree not to:

Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by applicable law.
Use the App to violate any law or third-party right.
Interfere with the App's intended operation or attempt to bypass HealthKit permissions or device security.
Redistribute, sublicense, sell, or rent the App.

4. Your data

You own the data you create in the App. As described in our Privacy Policy, that data is stored on your device and (where applicable) in Apple HealthKit. We do not store it on our servers and cannot recover it for you. You are responsible for backing up your device and managing your iCloud and Health settings.

5. Intellectual property

The App, including its name, design, source code, graphics, and content (other than your data and HealthKit data), is owned by Venture Ink, LLC and protected by copyright, trademark, and other laws. These Terms do not transfer any ownership to you.

"Apple," "iPhone," "iPad," "Apple Watch," "iOS," "HealthKit," and "Apple Health" are trademarks of Apple Inc., used for descriptive purposes only. Venture Ink, LLC is not affiliated with, endorsed by, or sponsored by Apple Inc.

6. Updates and availability

We may update, modify, or discontinue the App or any feature at any time, with or without notice. We are not liable for any unavailability or change to the App.

7. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL BE ACCURATE OR COMPLETE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL VENTURE INK, LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM, OR USD $10 IF GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

9. Apple-specific terms (App Store)

You acknowledge that these Terms are between you and Venture Ink, LLC, not Apple. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

10. Termination

These Terms remain in effect while you use the App. You may stop using the App at any time by uninstalling it. We may suspend or terminate your license to the App if you violate these Terms.

11. Governing law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law principles. Any dispute arising under these Terms will be resolved in the state and federal courts located in Colorado, unless required otherwise by applicable law.

12. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent version. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.
